Ensure that the time standards for commercial disputes are adhered for the following key court events:  
i.    First hearing; 
ii.    Filing of the statement of defense; 
iii.    Completion of the evidence period;
iv.    Filing of testimony by expert; and 
v.    Submission of the final judgment

Approved View File The amendments to the CPC by virtue of Commercial Courts Act prescribe that Court shall fix a case management hearing and shall fix the hearing to fix the timelines regarding the date of first hearing etc.While doing so,court has to ensure that the arguments are completed within 6 months of first court management date hearing.Order VIII Rule 1 CPC provides timelines for filing of Statement of defense.Order XX Rule 1 of CPC provide deadline for submission of final judgement.The same shall apply Details

Limit the maximum number of adjournments that can be granted in commercial disputes

Approved View File As per the attached notification, the commercial courts have been already constituted at the district level w.e.f. Oct 26, 2017. According to Order XVII Rule 1 of the Code of Civil Procedure, 1908 an adjournment can only be granted in exceptional circumstances and that the court may at any time during the stage of the suit adjourn the hearings for reasons to be recorded in writing, subject to a maximum of 3 adjournments being granted to a party during the hearing of the suit.
